A significant shift in the EU AI Act has quietly emerged — one that many organizations are overlooking amid discussions about deadline extensions and enforcement timelines. While headlines focused on the six – month delay for high – risk AI system enforcement to December 2027, there’s a more impactful change related to how compliance is assessed.
Instead of national authorities classifying high – risk AI systems, the responsibility now falls squarely on companies themselves. This transition to self – assessment means organizations must determine whether their AI systems fall under high – risk categories and certify their compliance accordingly. There’s no external body to defer to — if an organization gets this wrong, legal accountability rests with them.
This evolution in the EU AI regulatory framework marks a profound shift in corporate obligations. Rather than relying on a regulator’s stamp of approval, businesses now need robust internal governance, rigorous quality management systems, and clear compliance documentation to support their self – evaluations. Many companies are already turning to third – party validation to strengthen credibility with customers, investors, and insurers.
One critical part of the updated regime is Article 17, which mandates that high – risk AI providers maintain quality management systems (QMS) covering strategy, testing, monitoring, incident reporting, and more. prEN 18286, a European standard tied to Article 17, helps firms assume conformity if followed correctly. Organizations with ISO 42001 certifications also find themselves ahead of the curve because this voluntary international standard lines up with many prEN 18286 expectations.
Given this backdrop, organizations cannot treat the enforcement delay as a reason to postpone preparations. Lessons from GDPR show that late action leads to rushed compliance and unnecessary risks. Instead, firms must use this additional time strategically to understand their AI model risks, adopt conformity procedures, and ensure they meet all relevant requirements before enforcement deadlines tighten.
Compliance with the EU AI Act now demands proactive planning, robust internal processes, and clear documentation — or companies risk steep fines and reputational damage if they misclassify their systems or fail to comply.
